Our elected representatives in D.C. are faced with just such a circumstance. To impeach Joe Biden or not to impeach Joe Biden. This is almost always presented in an either/or metaphor: Scylla and Charybdis, a rock and a hard place, and so on. The essence of these arguments is that impeachment/no impeachment offers no good option. I submit that this is a form of the Fallacy of the Excluded Middle.

Special Counsel Jack Smith isn’t a stupid man. A number of definitions apply to Smith, but stupid isn’t one of them. A zealot? A vainglorious, demagogic political hack who is doing the bidding of another political hack? Yes, to both. But Jack Smith isn’t dumb.
Smith was the head of the public corruption unit at DOJ when, in 2014, he brought public corruption charges against sitting Virginia Governor Bob McDonnell. McDonnell was charged with 14 counts. Those counts included honest services wire fraud, obtaining property under “color of official right,” and extortion under “color of official right.” Like most DOJ attorneys with the power of the US government at their fingertips, charging McDonnell and his wife wasn’t enough. Smith’s team threatened to arrest McDonnell’s children if the governor and his wife discussed the case with them. After a three-week trial, he and his wife were convicted.

The main remaining difference between America’s liberal versus conservative Parties, the Democratic Party versus the Republican Party, is the amount of hypocrisy, the pretenses that the liberals pretend about their being progressive, which they pretend means their supporting minorities and women and gays against the majority and men and straights. It’s a ridiculous position, because it avoids and evades what’s important (which is what each individual — regardless of group — does, not what groupist category that individual might be a member of). This liberal deflection hides the guilty (who are the billionaires that are financing all of those public officials’ careers and their news-media that are getting them elected) and blames instead all members of some scapegoat-group (which promotes irrational hatreds and divides-and-conquers the public so that the super-rich can continue their skimming off the public).

Dershowitz: Jack Smith Could be Indicted for Fraud for Omitting Trump’s ‘Peaceful’ Statement

Harvard Law School professor emeritus Alan Dershowitz says that under his own “fraud” standard, Special Counsel Jack Smith could be indicted for omitting a key portion of then-President Donald Trump’s speech in Washington, D.C. on January 6, 2021.
The indictment charges Trump with four counts, including “conspiracy to defraud the United States.” But in a portion recounting Trump’s speech at the “Stop the Steal” rally, Smith repeats the errors made by House Democrats in Trump’s second impeachment trial: he focuses on Trump’s use of the phrase “fight like hell,” and omits a sentence highlighted by Trump’s defense team: “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.”
