President Joe Biden issued an executive order (EO) that allows the government to spy on Americans for broadly defined reasons including understanding \u201cpublic health risks,\u201d \u201cpolitical instability,\u201d and the \u201cthreat\u201d of climate change.<\/p>\n

The October 7\u00a0EO<\/a> is ostensibly written to \u201cenhanc[e] safeguards\u201d for \u201cUnited States Signals Intelligence Activities,\u201d which is intelligence gathering by the interception of signals, including communications, such as through cell phones, or those not used in communication.<\/p>\n

An accompanying\u00a0fact sheet<\/a>\u00a0explains that the EO is meant to help \u201cimplement the U.S. commitments under the European Union-U.S. Data Privacy Framework (EU-U.S. DPF)\u201d in an effort to \u201crestore trust and stability\u201d to transatlantic data flows. Thus, both Europeans and Americans are subject to the EO\u2019s provisions.<\/p>\n

The EO attempts to allay civil liberties concerns by explicitly prohibiting signals intelligence collection for the purposes of \u201csuppressing or burdening criticism or dissent,\u201d for example. However, the stated \u201clegitimate objectives\u201d of such signals intelligence collection opens the door to an extremely broad array of permitted reasons for interception \u2014 in other words, spying \u2014 by the U.S. government.<\/p>\n

Alongside permitting spying for the purposes of sizing up the capabilities of foreign entities, the EO permits signals intelligence collection for \u201cunderstanding or assessing transnational threats that impact global security, including climate and other ecological change, public health risks, humanitarian threats, political instability, and geographic rivalry.\u201d<\/p>\n

The document\u2019s lack of elaboration on such so-called \u201ctransnational threats\u201d raises the question of the true scope of activity now officially subject to spying by the U.S. government, which is potentially massive.<\/p>\n

Assessing the \u201cthreat\u201d of climate change, for example, could theoretically include collecting satellite signals to track the car travel of Americans and Europeans since car emissions are considered by climate activists to be one of the top sources of greenhouse gases.<\/p>\n

The document\u2019s wording also raises the question of what kind of activities are considered a threat to \u201cpolitical stability,\u201d since Biden has declared that \u201cMAGA Republicans\u201d \u201crepresent an extremism and a threat to the very foundations of our republic,\u201d and claimed that they \u201cdo not respect the rule of law.\u201d<\/p>\n

He\u00a0suggested\u00a0<\/a>such \u201cextremism\u201d is constituted by conservative beliefs in the right to life from the moment of conception, and in traditional marriage, declaring that \u201cMAGA forces are determined to take this country backwards \u2026 to an America where there is no right to choose \u2026 no right to marry who you love.\u201d<\/p>\n

\u201cUnderstanding and assessing\u201d a \u201cpublic health risk\u201d could also potentially entail tracking a wide range of information, including travel patterns and social activities, shopping habits, and genetic information such as that disclosed by the DNA testing service 23andMe.<\/p>\n
