The Kentucky senator says evidence compiled with Health and Human Services Secretary Robert F. Kennedy Jr. alleging felony conduct by Dr. Anthony Fauci has again gone unanswered by federal prosecutors.

Sen. Rand Paul, R-Ky., says the Justice Department under President Donald Trump has not acted on criminal referrals he submitted against Anthony Fauci, despite what Paul describes as documented evidence of felony conduct, including lying to Congress and improper handling of government communications.

Paul detailed the claims during an interview released this week on The Joe Rogan Experience, telling Joe Rogan that his efforts to pursue charges against Fauci date back to the Biden administration and have continued into Trump’s second term without response.
“Under the Biden administration, I sent criminal referrals for Anthony Fauci to Merrick Garland twice, and I sent them evidence that he had lied to Congress, which was a felony. They just ignored me,” Paul said during the interview, a segment of which was later circulated in a widely shared clip.

Paul said he has since worked closely with Robert F. Kennedy Jr., now serving as secretary of Health and Human Services, to gather additional material related to Fauci’s conduct while leading the National Institute of Allergy and Infectious Diseases.
“I’ve been working with Bobby Kennedy and he’s been very helpful on this. I have a good relationship with him,” Paul said. “He’s given us a lot of information and we’ve looked at the communications, and at Anthony Fauci’s communications. We now have evidence that he was telling people like Francis Collins: ‘Read this and destroy it.’”
Paul argued that such instructions would violate federal record-keeping requirements applicable to executive branch officials.
“You can’t do that,” he said. “The executive branch, when they communicate, they’re required to keep their communications and they’re required to do it on government devices.”
Paul said he summarized the newly compiled material and submitted another criminal referral to Trump’s attorney general, but again has received no indication that prosecutors are pursuing the case.
“So we have this evidence and I’ve summarized it again in a criminal referral to Trump’s attorney general. And I still haven’t gotten action,” he said.
During the interview, Paul also raised questions about whether Fauci could face accountability for what Paul alleges were false statements to Congress regarding U.S. involvement in gain-of-function research. He further questioned the legal durability of a pre-emptive pardon signed by former President Joe Biden, suggesting it could be challenged if issued broadly or executed by autopen.
“Can you give people a pardon for everything they did in a 10-year period? I can’t imagine,” Paul said. “And I think the court might narrow that, but it doesn’t happen unless the Trump Justice Department will do something. And I’ve been sending them referrals and I can’t get them to do anything.”
