Newly released records show Biden’s Department of Justice used secret subpoenas to obtain call logs and communications from Trump allies and members of Congress under a disputed 2020 election investigation.

A sprawling Department of Justice and FBI investigation code-named Arctic Frost secretly targeted President Donald Trump, his aides, Republican lawmakers, and conservative organizations under the guise of probing a 2020 “alternative electors” conspiracy, according to whistleblower disclosures and congressional records.

The investigation, launched under President Joe Biden’s Justice Department, sought to criminalize the Trump campaign’s efforts to arrange alternate slates of electors in states where election results were under legal challenge. Documents now declassified reveal the FBI issued nearly 200 secret subpoenas for records from more than 400 individuals and groups—actions legal experts have denounced as unconstitutional.

The opening document of the Arctic Frost probe claimed that “subjects corruptly conspired to obstruct the United States Congress’ certification of the 2020 Presidential election results by submitting fraudulent certificates of electors’ votes to the United States Government,” according to the Justice Department file.

Expansion of Scope

The operation was opened on April 13, 2022, by Timothy Thibault, then–Assistant Special Agent in Charge at the FBI’s Washington Field Office. Within weeks, Sen. Chuck Grassley (R-Iowa) questioned Thibault’s anti-Trump social media activity. He retired four months later.

Initially targeting Trump campaign associates and roughly 60 alternate electors across Arizona, Georgia, Michigan, Nevada, and Wisconsin, the investigation quickly expanded. By May 2022, the FBI had even seized the government-issued phones of both Trump and Vice President Mike Pence, according to emails obtained by Sens. Grassley and Ron Johnson.
