Democratic politicians and activists reassured liberty-loving Americans that President Donald Trump’s Supreme Court nominee is the perfect candidate for the court if they are concerned about preserving Second Amendment rights for the next generation.
Trump’s pick, D.C. Court of Appeals Judge Brett Kavanaugh, is an ardent supporter of the Second Amendment and has a longstanding history of defending this constitutionally protected right.
Fox News reports that in a case that followed the U.S. Supreme Court’s 2008 Heller v. D.C. decision, Kavanaugh dissented when “a D.C. U.S. Circuit Court of Appeals panel ruled that Washington, D.C. could ban the possession of most semiautomatic rifles.”
In his dissent, Kavanaugh wrote:
In Heller, the Supreme Court held that handguns – the vast majority of which today are semi-automatic – are constitutionally protected because they have not traditionally been banned and are in common use by law-abiding citizens. There is no meaningful or persuasive constitutional distinction between semi-automatic handguns and semiautomatic rifles. Semi-automatic rifles, like semi-automatic handguns, have not traditionally been banned and are in common use by law-abiding citizens for self-defense in the home, hunting, and other lawful uses. Moreover, semiautomatic handguns are used in connection with violent crimes far more than semi-automatic rifles are. It follows from Heller’s protection of semi-automatic handguns that semi-automatic rifles are also constitutionally protected and that D.C.’s ban on them is unconstitutional.
Later in his dissent, Kavanaugh added: “Gun bans and gun regulations that are not longstanding or sufficiently rooted in text, history, and tradition are not consistent with the Second Amendment individual right.”
Moments after Kavanaugh was announced as Trump’s Supreme Court nominee, Democrat politicians and activists quickly reassured conservatives that he is the right choice for preserving gun rights.
Brett Kavanaugh is a true Second Amendment radical. He believes assault weapon bans are unconstitutional, a position way out of the judicial mainstream, far to the right of even late Justice Scalia.
